Terms and Conditions.

Applicability

These terms and conditions are applicable in cases where Swedish or other applicable law does not prescribe terms that are in conflict with these. For private consumers, the law on distance contracts and contracts outside business premises (DAL) applies, and for companies - the Purchase Act.

General

Gram Malmö AB, org.nr. 559060-3980, (referred to as "Gram", "Company", "We", "Us") is a package-free store both in Malmö, Sweden, and online. The following general terms and conditions apply to all orders made by a customer via www.grammalmo.se (the "Website"). To make a purchase in the webshop, a customer must accept the terms and conditions. We reserve the right to change the terms of this agreement in the future without prior notice to you. If you have questions about our terms and conditions, your delivery or any other issues, please feel free to contact us at webshop@grammalmo.se.

All prices on www.grammalmo.se include VAT. Shipping costs may be added at the checkout. In the shopping cart and at checkout, the total price including VAT is shown after any discounts have been deducted. Gram reserves the right to make changes to prices and product selection without prior notice. In these cases, we reserve the right to change or cancel an order if the price has been set incorrectly. This applies even if the order confirmation has already been received.

Ordering

You agree to our terms and conditions and our privacy policy when making purchases via the Website. When orders are received, an order confirmation is automatically sent by e-mail to your registered e-mail address. We can only deliver within Sweden and therefore do not accept orders from other countries.

The customer must have reached the age of 18, be of legal age and have the full legal right to get involved with an agreement with another party. Clients under the age of 18 must obtain the guardian's permission before the purchase can be completed.

 Allergies

Although we take precautions, we cannot guarantee that our food products do not contain traces of nuts, soy, sesame or gluten because all food products are packed in the same environment.

 Payment

You place an order by clicking on "Complete Purchase" at checkout. If you have received a discount code, it is used at checkout before you complete your purchase. It is not possible to combine discount codes with other discounts or to combine several discount codes.

At checkout, information about the order is displayed and the payment method(s) available will be provided. We currently accept only card payment.

Pay at once with your bank account. We accept VISA, MasterCard and American Express, JCB, and Apple Pay through Stripe, and the amount is deducted directly from your account at the time of purchase. Gram does not handle or store card information and all information is encrypted in accordance with current standards and regulations.

Promotions, offers and discounts

Promotions, offers and discounts may have special conditions. If you visit the webshop after the promotion period, the discounts received cannot be used for a new order. Discount codes do not apply when buying gift cards.

 Shipping

Depending on delivery alternatives, a shipping cost of SEK 49kr will be added to all orders under SEK499kr. An automatic free shipping will be applied with orders over SEK499kr.

Delivery

It is the buyer's responsibility to ensure that the address provided to us at the time of ordering is correct, and that the buyer, after we have executed the order, follows up the delivery with the courier, and ensures that the delivery is picked up / received at the pickup point within a reasonable time (usually 14 days from dispatch). Delivery takes place only within Sweden.

Our deliveries currently take place via two freight forwarders:

1. Postnord, domestic letter. Shipments under 2kg.

2. Postnord, domestic parcel. Shipments over 2kg.

Delivery time is calculated from the day we confirmed the order. An order confirmation is sent out within 48 hours (not including Saturday and Sunday) after the time of purchase and from that date, the delivery time begins to count. However, there might be occasional delay with delivery due to issues like inventory damage. We’ll notify through email if this happens.

Once your package has been sent, it normally takes 3-5 business days to deliver. Delivery delays may occur and we can not provide any guarantee for the delivery time. If delivery cannot take place within the agreed time, you will be informed without undue delay of the reason and informed of a new delivery time. If Gram is unable to rectify the defect within a reasonable time and the delivery time is of significant importance, you, as a consumer, have the right to cancel the purchase. This also applies to special orders.

When your package is ready to leave our warehouse, we will send a delivery confirmation with tracking link and your package number. When you click on the tracking link, you will come to the tracking service to track where your package is. To pick up your package, you need valid identification and the package / serial number that you receive via text message or letter.

We charge a fee of SEK 150 for orders that are not picked up from the postal agent where the order was sent. The fee covers return shipping, handling and administration.

Unfortunately, we have to pack the products to prevent damage during transportation. However, we try to use as much used packaging material as possible to reduce packaging waste. We will contact you as soon as possible if we notice that a product is no longer in stock.

Delivery responsibility

Gram is responsible if the goods are lost or damaged during shipment. If the product is damaged during the transportation, this should be reported immediately by contacting us.

 

Delivery delay

The company is not responsible for delays caused by our logistics partners or manufacturers. In cases where Gram is the cause of a delivery delay, you have the right to cancel the purchase if you do not accept a new delivery time.

 

Error handling

Should an item be incorrectly dispatched, Gram undertakes to fix the error free of charge.

 

Change/cancellation

Changes/cancellations must be made by contacting us. A change can take place until an order has been packed. A cancellation is not valid until you have received a confirmation from us.

The company reserves the right to cancel the order or cancel delivery if the customer has stated missing or incorrect information during registration or in case of force majeure-like events. If such an exceptional case occurs, you will be notified as soon as possible.

Right of withdrawal

When purchasing goods on the website, you as a customer have a statutory 14-day right of withdrawal that applies from the time you have received the item you have ordered. However, the right of withdrawal does not apply to goods that can deteriorate quickly.

 

The right of withdrawal does not apply to:

  • Goods that can deteriorate rapidly, such as food.

  • Goods that have been sealed due to health or hygiene reasons and the seal has been broken by the consumer.

When exercising the right of withdrawal

Let us know that you want to return an item by contacting us. The message must state clearly the customer’s name, address, e-mail address, order number and which goods the return applies to. Once we have approved the return, the customer should return the products to Gram immediately and no later than 14 days after the cancellation notice.

The customer is responsible for return shipping and the products should be packed well in their original packaging. We reserve the right to deduct the corresponding depreciation compared to the original value of the item when the product is used or damaged on the refund amount.

Right of complaint

If there is something wrong with the delivered products, you have the right to issue a complaint. You’d need to file the complaint as soon as possible after delivery. You do this by taking a picture of the product and sending it to us. The right to make a complaint arises when the product is faulty or when the product does not meet the quality requirements. The company examines the complaint and replaces approved complaints with the value of the product.

 

Reservation for changes

Gram reserves the right to the final sale as well as any image and writing errors on the website, such as errors in the product description or table of contents, incorrect prices, incorrect maximum quantity when ordering an item or incorrect information regarding whether an item is in stock.

If an incorrect price has been entered for an item that the customer has ordered, Gram will notify the customer. We will wait for the customer's approval of the corrected price before starting to pack the customer's order. Also, in the case that the approval is not obtained, we have the right to remove the item from the customer's order.

 

Copyright

All material such as graphics, illustrations, photographs, videos and texts on www.grammalmo.se are protected by copyright law. You may not use our material without our permission. This applies both to personal use and in commercial contexts.

 

Force majeure

Gram is not liable for delays caused by circumstances beyond our reasonable control and is in that case entitled to additional time for the fulfillment of its obligations. Examples of such circumstances are strikes, terrorist attacks, arson, lightning, war; supplier, transport or production disruptions; changed regulatory provision, natural disaster and error or delay from a subcontractor due to circumstances stated here.

 

Applicable law and dispute

If a dispute cannot be resolved between the customer and the company, you as a customer can turn to ARN (The National Board for Consumer Disputes) or ultimately to a general court.
